Can 8 year old ride on the back of a Harley Davidson in Ohio?
Lauri asked:
My ex-husband owns a Harley Davidson Motorcycle and would like our eight year old daughter to ride on the back with a helmet. We live in Ohio. Is there an age in Ohio to ride as a passenger? My concern is that this is not safe. He doesn't wear a helmet which in my opinion doesnt set a good example....Any input greatly appreciated!!!

sure get the little tart started early! She can ride mine when she’s older!!
as you know different states have different laws in reference to helmet use. also lots of laws about having juveniles restrained. an 8 year old does not fall under the juvenile safety seat laws but must be restrained if the vehicle has restraints installed. so on a motorcycle no restraint is available and that does not apply. basically yes an 8 year old can ride on the bike but if Ohio is a no helmet state then it is not required. i think< i am a police officer and a parent> that if you allow your child to ride with no helmet your are being totally irresponsible. you just have make a personal choice as to allow her to ride at all. i lost my father to a motorcycle accident and he was wearing a helmet and recommended gear so it doesn’t always matter if its used. statistically a rider is safer with the right equipment but i can tell you from personal experience as well as work experience that sometimes it just doesn’t matter depending on the circumstances. YES NOT USING A HELMET IS A SERIOUSLY BAD EXAMPLE, AND SPARE ME ALL THE PERSONAL FREEDOM OF CHOICE JAZZ, ITS JUST STUPID NOT TO WEAR ONE! ON THE OTHER HAND ALL YOU NO HELMET PEOPLE WILL EVENTUALLY BECOME A VICTIM OF DARWINISM- JUST DO ME A FAVOR AND DO IT BEFORE YOU BREED!!!
no dont let him on it my uncle got hurt on one it is not save for him to be on it
Ohio Statute
Title XLV. Motor Vehicles–Aeronautics–Watercraft. Chapter 4511. Traffic laws–Operation of Motor Vehicles. Bicycles. Section 4511.53 Rules for Bicycles, MOTORCYCLES and Snowmobiles. :
“. . . No person who is under the age of eighteen years, or who holds a motorcycle operator’s endorsement or license bearing a “novice” designation that is currently in effect as provided in section 4507.13 of the Revised Code, shall operate a motorcycle on a highway, or be a passenger on a motorcycle, unless wearing a protective helmet on his head, and no other person shall be a passenger on a motorcycle operated by such a person unless similarly wearing a protective helmet. . . .”
It doesn’t matter what kind of ‘example’ it sets. I don’t wear a helmet on my motorcycle, but I can guarantee you that my kid will. Adults should have the right of choice, but kids do not. That’s why they have parents or guardians. In your case, choice has no bearing since it’s Law.
